Terms of Service
Last updated: April 22, 2026
1. Nature of the Services
Nicke Studio (the "Provider") supplies digital creative services including, but not limited to, web development (SaaS/landing pages), professional video editing, AI automation and profile design (the "Services").
By engaging our services through any official channel listed on this website, the Client accepts all terms described in this document.
2. Proposals, Fees and Payments
- Initial approval: Every project requires approval of a written brief and an itemized quote.
- Deposit structure: Unless mutually agreed otherwise, no slot will be reserved and no project work, including recording or code, will begin without the non-refundable advance payment specified in the quote, usually 50%.
- Final payment: The remaining payment (50%) must be paid in full before transfer of the final product without watermarks, production deployment or delivery of source code.
3. Revisions and Deliverables
To preserve technical standards and working time, each quote specifies a strict limit on review rounds.
- Any substantial structural change or change to the brief requested after submission of the original prototype or draft will incur additional hourly charges.
- Unless an Extended Resource License is purchased, raw footage and editable project files (Premiere/After Effects/Figma) will not be supplied. Deliverables consist exclusively of the final product, such as a render or compiled web application.
4. Copyright and Portfolio
Upon completion of payment, the Provider grants the Client the right and a perpetual license to publish the final work on the platforms for which it was created.
However, the Provider retains the moral and irrevocable right to display completed work or derivatives of the Services, including renders, UI excerpts and screenshots, on its business social channels, video reels, case studies and website portfolio, unless a mutual commercial non-disclosure agreement (NDA) has been expressly negotiated and priced.
5. Third-party Failures and Responsibility
When integrating software architectures, the Provider assumes no civil, criminal or commercial responsibility for disruptions caused by third parties directly connected to the application, including:
- Vercel/AWS or cloud-hosting maintenance.
- Algorithmic restrictions imposed by social platforms such as TikTok or Instagram on delivered videos.
- Changes to connected automation APIs, such as Make.com or bulk-email services.
6. File Retention
The Client is strongly advised to download and back up final products immediately upon delivery. For storage efficiency, the agency will permanently delete local databases, unpublished code and temporary assets 30 days after final delivery.
